The magistrate was decisive in the sentence about the constitutionality of the Catalonian Authonomy Statute, which indeed proclaim this region of spain as a Nation itself. It also gives ban powers over Spanish foreign policy agreements and reclaim, for the local government, almost all state powers. For the rest of them, this statue regulate trough bilateral, same level negotiations, any policy that directly or indirectly affects Catalonia, !Even foreign policy!.

The central government is also commited to opressive regulations, passing education laws that violate the constitutionsl garanties. En cuanto a poner uno "de los míos" (¿cuándo he hablado en plural?), pues no, porque:
1) No soy socialista;
2) El PP puede bloquear la renovación de Consejo General del Poder Judicial si no se elige a un conservador;
3) Aunque no lo creas, existe una ética en lo referente a los nombramientos de los magistrados, por pérfido que nos parezca el hecho de pactar el nombramiento de jueces.
Agradecería que si vas a responderme, te abstuvieras de insultarme, o me veré obligado a pedirle al dueño del blog que active el filtrado de comentarios y acuda en mi defensa (aunque pensemos de manera diferente, me imagino que velará por el respeto en su bitácora).

El TSJA ha suspendido parte de los contenidos de EpC aludiendo a la inconstitucionalidad. Por lo visto en el extranjero conocen mejor que tú estas cosas.
Lo que no sé es porque hacéis chistes de mal gusto con el sentimiento de la gente mientras metéis la pata. Eso es educar ¿no?

Os gustará saber que los tribunales ordinarios sí tienen competencia para conocer sobre la constitucionalidad de normas infralegales (reglamentos, contratos...). El TSJA ha anulado unos reglamentos que desarrollan EpC.
Sin embargo, el razonamiento del TSJA es político y no jurídico, así que la sentencia será anulada por el Tribunal Supremo. Al final llegará al Constitucional (que denegará el derecho a objetar, que no está reconocida en la Constitución).
Y si llegan a TEDH, pues tampoco les hará mucho caso, porque la Carta Europea de Derechos Humanos es un convenio de mínimos, y el tema de EpC es un asunto de máximos.

ResponderEliminarY además EpC es una asignatura promovida por el Consejo de Europa, así que malamente va el Tribunal Europeo de Derechos Humanos a enmendar una asignatura que precisamente está para promover los Derechos Humanos.
Por cierto, el inglés infumable. En serio. Lleno de faltas de ortografía y de expresiones traducidas literalmente del castellano sin ningún sentido. Lo digo como crítica constructiva.
