Spanish decisive magistrate died of unknown causes. Authopsy result not known after a week

The magistrate was decisive in the sentence about the constitutionality of the Catalonian Authonomy Statute, which indeed proclaim this region of spain as a Nation itself. It also gives ban powers over Spanish foreign policy agreements and reclaim, for the local government, almost all state powers. For the rest of them, this statue regulate trough bilateral, same level negotiations, any policy that directly or indirectly affects Catalonia, !Even foreign policy!.

After a week from its death , still the authopsy is not known. this happens just before the Court decission. Causes still are not known. Many of us have serious suspicions, since this is not, by no means the only "fortunate" coincidence that favors the policies of the socialist government.

This is the last event after a series of pressures and caracter assasination of the conservative constitutional court magistrates by the side of the socialist government and the nationalists that share the power.

Spain has not a real liberal democracy, lacking a separation of state powers. Lawyers in higher courts are designated directly by the parliament by a system of party quotes, and the parliament elect the prime minister. Votation lists are closed for the Congress, so that the party leaders have the power to elect almost anything, from the list of congressmen to the high court magistrates. The party in power, after the second legislature, assures its majority of designed non-independent magistrated in the higher courts.

The socialist goverment is using these almost dictatorship prerogatives for advancing in its agenda for a transition to a regime that debilitates these institutions even more. Its goal is to empty the central state towards a confederation of nearly nindependent states. This is by no means a road to less government; The Autonomous governments are more and more opressive, by regulating even more and more aspects of our private lifes. The central government is also commited to opressive regulations, passing education laws that violate the constitutionsl garanties. The "opportune" death of the magistrate, for sure will end up in the sanction as "constitutional" for all such laws.

Four years later, a sentence says that the intellectual authors of the 2004 september 11 train massacre , are not known. We still wait a real investigation four years later.

Strange things happens in Spain since four years ago the socialist party, and his leader, Zapatero, won the elections three days after the massacre, which they used dishonestly, to say the least, in the campaign, with false accusations that later were proved to be false.

Each day, more and more unknown things accumulate here in Spain. And we really want to know. At least we want you to know it, wherever you are.

    ¿Dónde te he faltado yo al respeto a ti? ¿Dónde has visto que te insulte? Pues reclamo lo mismo para. mi. Exijo una disculpa.

    En cuanto a poner uno "de los míos" (¿cuándo he hablado en plural?), pues no, porque:

    1) No soy socialista;
    2) El PP puede bloquear la renovación de Consejo General del Poder Judicial si no se elige a un conservador;
    3) Aunque no lo creas, existe una ética en lo referente a los nombramientos de los magistrados, por pérfido que nos parezca el hecho de pactar el nombramiento de jueces.

    Agradecería que si vas a responderme, te abstuvieras de insultarme, o me veré obligado a pedirle al dueño del blog que active el filtrado de comentarios y acuda en mi defensa (aunque pensemos de manera diferente, me imagino que velará por el respeto en su bitácora).

    El TSJA ha suspendido parte de los contenidos de EpC aludiendo a la inconstitucionalidad. Por lo visto en el extranjero conocen mejor que tú estas cosas.

    Lo que no sé es porque hacéis chistes de mal gusto con el sentimiento de la gente mientras metéis la pata. Eso es educar ¿no?

  9. El TSJA no tiene ninguna autoridad sobre temas constitucinales. Afortunadamente. Lo mismo les ocurre a los TSJPV o el TSJC, como seguramente te gustará saber.

    Os gustará saber que los tribunales ordinarios sí tienen competencia para conocer sobre la constitucionalidad de normas infralegales (reglamentos, contratos...). El TSJA ha anulado unos reglamentos que desarrollan EpC.

    Sin embargo, el razonamiento del TSJA es político y no jurídico, así que la sentencia será anulada por el Tribunal Supremo. Al final llegará al Constitucional (que denegará el derecho a objetar, que no está reconocida en la Constitución).

    Y si llegan a TEDH, pues tampoco les hará mucho caso, porque la Carta Europea de Derechos Humanos es un convenio de mínimos, y el tema de EpC es un asunto de máximos.

    Y además EpC es una asignatura promovida por el Consejo de Europa, así que malamente va el Tribunal Europeo de Derechos Humanos a enmendar una asignatura que precisamente está para promover los Derechos Humanos.

    Por cierto, el inglés infumable. En serio. Lleno de faltas de ortografía y de expresiones traducidas literalmente del castellano sin ningún sentido. Lo digo como crítica constructiva.
